2. Scope and Subject Matter
2.1. These Terms and Conditions govern the contractual relationship between DeleteApp ("Provider") and business customers ("Customer") relating to the use of DeleteApp's review monitoring, analysis, and dispute-assistance services for Google Business Profiles.
2.2. DeleteApp's services are offered exclusively to businesses (entrepreneurs within the meaning of Section 14 German Civil Code/BGB). Services are not provided to consumers.
3. Description of Services
3.1. DeleteApp provides Customers with:
- Monitoring and analysis of publicly available Google Business Profile reviews
- Identification of reviews that may be misleading, unlawful, fraudulent, or otherwise in violation of Google's content policies
- Assistance in preparing and submitting formal dispute requests to Google through Google's official processes
- Provision of analytics, insights, and consulting services related to online review management and compliance
3.2. DeleteApp does not modify, alter, suppress, delete, or otherwise manipulate customer reviews. All final decisions regarding review visibility or removal are made solely by Google.
3.3. DeleteApp does not guarantee a specific outcome of any dispute request. Success depends exclusively on Google's evaluation of the reported content.
4. Conclusion of Contract and User Account
4.1. Registration of a user account is required to use the services. The Customer must provide accurate and complete information and promptly update any changes.
4.2. The Customer is responsible for keeping account credentials confidential and is liable for all activities conducted through the user account.
5. Prices, Payment, and Invoicing
5.1. Pricing is based on the price list in effect at the time of contracting and is displayed in U.S. dollars unless otherwise stated.
5.2. Payments are made in advance via credit card or other available payment methods and processed securely by Stripe or equivalent payment processors.
5.3. In case of late payment, DeleteApp may suspend access to services until payment is received.
6. Refunds
6.1. Refunds may be provided if a dispute assistance service cannot be performed due to technical issues or if explicitly agreed in individual cases.
6.2. Requests for refunds must be submitted within 30 days of the transaction date.
7. Customer Duties and Responsibilities
7.1. Customers agree to use the services in accordance with applicable law and Google's content policies.
7.2. Customers must not use the service to file dispute requests for lawful or legitimate customer reviews, or for purposes that are unlawful, misleading, or manipulative.
8. Limitation of Liability
8.1. DeleteApp's liability is limited to intentional acts and gross negligence. For slight negligence, liability is only for breaches of essential contractual obligations ("cardinal duties"), and then only for typical foreseeable damages.
8.2. The aforementioned limitations do not apply to damages resulting from injury to life, body, or health, or in cases of mandatory statutory liability (e.g., under product liability laws).
8.3. Liability for lost profits, indirect or consequential damages is excluded.
9. Rights to Content and Data
9.1. Copyright and all other intellectual property rights in content, services, and software remain with the Provider.
9.2. The Customer retains ownership of all data submitted. The Provider is granted a simple right to use such data as necessary to perform the contract and improve services.
9.3. The Customer guarantees that use and transmission of their data does not infringe third-party rights.
10. Confidentiality and Data Protection
10.1. Both parties undertake to keep confidential all information that becomes known within the scope of the contractual relationship.
10.2. The processing of personal data is carried out in accordance with the current Privacy Policy and applicable data protection legislation, in particular the GDPR.
11. Amendments to These Terms
11.1. The Provider reserves the right to amend these Terms and Conditions for the future. Amendments will be provided to the Customer at least four weeks prior to their effective date in text form (e.g., email or via the customer account).
11.2. If the Customer does not object within four weeks of receipt of the notice, the amendments are deemed accepted. Customers will be expressly informed of this right of objection in the notice.
12. Contract Term and Termination
12.1. Contracts are concluded for the agreed term and automatically expire unless otherwise specified.
12.2. The right to extraordinary termination for good cause remains unaffected, in particular in the case of serious breaches of contract.
13. Final Provisions
13.1. All claims arising from or in connection with this contract are governed exclusively by the law of please select and specify.
13.2. The exclusive place of jurisdiction for all disputes arising from or in connection with this contract, to the extent permitted by law, is the registered location of DeleteApp.
13.3. If any provision of these Terms is invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by the statutory rule.
13.4. The currently valid version of the Terms and the Privacy Policy are available at Terms and Privacy Policy at all times.
